Agap.AI Technologies Corp. ("we," "us," or "our"), a corporation duly organized and existing under the laws of the Republic of the Philippines with principal address at 2nd Floor Warehouse 3, 3 Sheridan Street, Buayang Bato, Mandaluyong City, Philippines, is committed to protecting the privacy of your child's information and your personal data. This Privacy Policy outlines our practices in compliance with the Data Privacy Act of 2012 (Republic Act No. 10173)and other relevant Philippine laws and regulations concerning data privacy and protection. By using our AGAPAI mobile application (the "App"), you signify your free and informed consent to the collection, use, processing, and sharing of your personal data and your child's information as described herein.

1. Information We Collect

In order to provide and improve the AGAPAI App, we collect the following types of information:

  • Child's Personal Information: This includes details you voluntarily provide about your child, such as their name (optional), date of birth, gender (optional), and the records of developmental milestone activities you input into the App. This information is essential for tracking and analyzing your child's progress.

  • Parent/Guardian's Personal Information: When you register and use the App, we collect your personal information, including your full name, email address, contact number (optional), and other details you provide during the account creation process. This information is necessary for account management, communication, and verification.

  • Usage Data and Analytics: We automatically collect certain information about how you and your child use the App. This may include the features accessed, the frequency and duration of use, the types of milestones tracked, and other usage patterns. We may use analytics tools to help us understand user behavior and improve the App's design and functionality. This data is often aggregated and anonymized.

  • Device Information: We may collect technical information about the mobile device you use to access the App, such as the device model, operating system version, unique device identifiers (e.g., IMEI or device ID), IP address, and mobile network information. This helps us optimize the App for different devices and troubleshoot technical issues.

 

2. How We Use Your Information

We process your personal data and your child's information for the following legitimate purposes:

  • To Deliver the AGAPAI Service: To enable you to effectively track your child's developmental milestones, utilize the App's features, and receive personalized insights based on the recorded data.

  • For AI Model Improvement and Research: We may use the collected data, after undergoing anonymization and aggregation to prevent individual identification, to train and enhance the accuracy and cultural relevance of our AI model. This allows us to improve the App's ability to detect early signs of developmental variations and provide more effective support.

  • Communication and Support: We may use your contact information to communicate with you regarding your account, provide updates about the App, respond to your inquiries, offer technical support, and send you relevant information about child development.

  • App Security and Maintenance: To ensure the security, stability, and functionality of the App, including monitoring for and preventing fraud, unauthorized access, and other potential misuse.

  • Compliance with Legal Obligations: We may process your personal data when necessary to comply with applicable Philippine laws, regulations, legal processes, or governmental requests.

 

3. Data Security Measures

We are committed to implementing reasonable and appropriate organizational, physical, and technical security measures to protect your personal data and your child's information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access, and other unlawful forms of processing. These measures include:  

  • Encryption: Employing industry-standard encryption techniques to secure data during transmission (e.g., using HTTPS) and at rest.

  • Access Controls: Limiting access to personal data to authorized personnel who have a legitimate need to know.

  • Regular Security Audits: Conducting periodic security assessments and vulnerability testing to identify and address potential risks.

  • Data Minimization: Ensuring that we only collect and retain personal data that is necessary for the purposes outlined in this Privacy Policy.

  • Secure Data Storage: Storing personal data on secure servers with appropriate safeguards.

While we strive to protect your information, please be aware that no method of data transmission over the internet or electronic storage is completely infallible.  

 

4. Children's Privacy and Parental Consent

We recognize the sensitive nature of children's information and are committed to protecting their privacy in accordance with the Data Privacy Act of 2012 and other relevant child protection laws in the Philippines.

  • Parental Consent: By registering and providing information about your child, you represent and warrant that you are the child's parent or legal guardian and that you provide your free and informed consent to the collection, use, and processing of your child's personal information as described in this Privacy Policy.

  • Limited Collection: We will only collect personal information from your child that is directly relevant and necessary for the intended purposes of the App.

  • No Direct Contact: We will not directly contact your child through the App. All communication will be with the parent or guardian.

  • Parental Rights: As a parent or legal guardian, you have the right to access, review, correct, update, restrict the processing of, or request the deletion of your child's personal information held by us. You may exercise these rights by contacting us through the channels provided within the App.

 

5. Sharing of Information

We will only share your personal data and your child's information under the following limited circumstances:

  • With Your Explicit Consent: We will share your information with third parties if you have given us your explicit consent to do so.

  • With Third-Party Service Providers: We may engage trusted third-party service providers who assist us in operating the App, performing data analysis, providing technical support, or other services. These providers are contractually bound to protect your information and process it only in accordance with our instructions and applicable data privacy laws.

  • For Legal Compliance: We may disclose your information if required to do so by law, subpoena, court order, or other legal process, or if we believe in good faith that such disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of others.  

  • In Aggregated and Anonymized Form: We may share aggregated and anonymized data that does not personally identify you or your child with researchers, partners, or for statistical purposes related to child development.

 

6. Data Retention

We will retain your personal data and your child's information only for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable Philippine laws and regulations. When the data is no longer needed, we will take reasonable steps to securely destroy or anonymize it.  

 

7. Your Rights as a Data Subject (Under the Data Privacy Act of 2012)

As a data subject under the Data Privacy Act of 2012, you have the following rights:

  • Right to be Informed: You have the right to be informed of whether personal data pertaining to you shall be, are being, or have been processed, including the existence of automated decision-making and profiling.  

  • Right to Access: You have the right to reasonable access to, upon demand, the following: (a) contents of your personal data that were processed; (b) sources from which personal data were obtained; (c) names and addresses of recipients of the personal data; (d) manner by which such data were processed; (e) reasons for the disclosure ofpersonal data to recipients, if any; (f) information on automated processes where the data will or likely to be made as the sole basis for any decision that significantly affects or will affect the data subject; (g) date when your personal data concerning you were last accessed and modified; and (h) the identity and contact details of the personal data controller and its representative, as well as of its data protection officer, if any.  

  • Right to Rectification: You have the right to have your personal data corrected or updated without delay whenever it is inaccurate or incomplete.

  • Right to Erasure or Blocking: You have the right to suspend, withdraw, or order the blocking, removal, or destruction of your personal data from our filing system under certain circumstances as provided by law.  

  • Right to Object: You have the right to object to the processing of your personal data under certain circumstances, including processing for direct marketing, automated processing, or profiling.  

  • Right to Data Portability: You have the right to obtain a copy of your personal data in an electronic or structured format that is commonly used and allows for further use by you.  

  • Right to File a Complaint: You have the right to file a complaint with the National Privacy Commission (NPC) if you believe that your rights under the Data Privacy Act of 2012 have been violated.  

  • Right to Damages: You have the right to be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of personal data, taking into account any violation of your rights and freedoms as data subject.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our data practices, legal requirements, or the functionality of the App. We will notify you of any material changes by posting the updated Privacy Policy within the App or by other reasonable means (e.g., email notification). The "Effective Date" at the top of this policy will indicate when the latest revisions were made. Your continued use of the App after the effective date of the revised Privacy Policy constitutes your acknowledgment and acceptance of the changes.
